Accident Investigation:

When a large accident occurs in the shipping industry it doesn’t take long before it is global knowledge. But when their name is cleared from any wrong doing, it is hard to get this news spread.

We cannot offer to spread the good news but MBM-Consultancy can assist in providing ship-owners and operators in the first stage by determining a defendable stand point for their case.

 

Even a small loose cargo in a hold can cause a claim in the millions of dollars, due to minor structural hold damage with penetration holes to Heavy Fuel Oil tanks (HFO tanks). MBM-Consultancy has experience in dealing with this type of investigation and has the skills necessary to gather and interpret the pre-accident facts that lead to determine the cause and then present these facts in a favorable presentation.

 

MBM-Consultancy always keeps an open mind and looks further to find ways to gain a different defendable approach where necessary. The approach looks into the age of vessel, when was she last inspected, what repairs had she had done, was there signs of erosion or corrosion, how was the other cargo stowed and secured and is it possible one of these broke free, thus causing a ‘chain reaction’ by breaking a lashing chain! or as in a recent case, was the provided cargo in a sea going condition? We also investigate the initial calculations for sea accelerations to determine if they were realistic compared to the vessel sailing condition and the actual stowage compared to the stowage plan intended. A minor change may be within a suitable margin to meet the forces exerted on the lashing calculations, but may not be suited to the vessel structure.

 

Although it is not ethical to fully provide details here of any case we have successfully defended, there are many ship-owners and operators names that have been cleared by MBM-Consultancy due to our open-minded approach to investigate the incident and provide a defendable conclusion.

We continually work to establish a combination of facts that best present our client’s position and can be presented by the clients lawyers in a court of law (n.b. all technical points are provided and explained in scientific notation and explained in plain English terms to assist the Lawyer).
